1.2 These terms and conditions apply to every use of the Web Shop, every offer of LUKA FLORES in the Web Shop, every purchase of Products via the Web Shop and all Agreements concluded and to be concluded between LUKA FLORES and the Customer and associated obligations.
2. USE OF THE WEB SHOP
2.1 The Web Shop may only be used by Customers.
2.2 By using the Web Shop, the Customer agrees:
i) only to use the Web Shop for legitimate purposes or Orders;
ii) not to use the Web Shop in the scope of trading, commercial or professional activities;
iii) to keep his or her (login) data of the Web Shop confidential and not to provide these data to third parties;
iv) not to place any false or fraudulent Orders;
v) to provide LUKA FLORES the correct (contact) information truthfully and exactly;
vi) that these general terms and conditions apply.
3.1 The Products may have limited quantities.
3.2 Illustrations of the Products in the Web Shop are indicative. Colours on the Customer’s computer display may differ from the Product’s colors. Sizes specified in the Web Shop are also indicative.
3.3 All offers are without obligation; an Order only binds LUKA FLORES after LUKA FLORES has accepted the Order.
3.4 Obvious mistakes or errors in the offer of Products do not bind LUKA FLORES.
4. THE PRICE
4.1 The price of the Products is the price specified in the Web Shop, unless an obvious error is involved.
4.2 In the event of obvious errors in prices, LUKA FLORES will inform the Customer who placed an order of this as soon as possible. The Customer will then have the possibility to confirm the Order at the corrected price or to cancel the Order. In the event that LUKA FLORES fails to contact the Customer, the amount paid by the Customer will be refunded.
4.3 Product prices include any applicable VAT, but do not include shipping costs. The shipping costs will be added to the total amount. The amount of the shipping costs is clearly specified during the order process.
4.4 Prices can be changed at any time, except the Orders that LUKA FLORES has confirmed.
5. ORDERING. ESTABLISHMENT OF THE AGREEMENT
5.1 An Order is placed by the Customer completing the order process in the Web Shop. The Customer must provide the necessary data for the order fulfilment, including first name, last name, phone number, shipping address and any other information as requested.
5.2 Subject to what is stipulated in paragraph 3, an Agreement is established once LUKA FLORES has electronically confirmed the receipt of an Order and the Customer has satisfied the conditions stipulated with the Order.
5.3 In the event that LUKA FLORES has valid reasons for not entering into the Agreement, it is entitled to refuse an Order or to stipulate special conditions for fulfilment.
6.1 The Customer makes the payment in accordance with the payment methods offered in the order procedure and in accordance with the conditions stipulated.
6.2 LUKA FLORES accepts the following payment methods: PayPal, Paysera and credit cards (Visa, Mastercard) processed via Paysera system. Please note that depending on the customer’s country of residence, either all or certain payments mentioned above can be available.
6.3 The Customer must immediately notify LUKA FLORES of any inaccuracies in payment information that he or she has provided or specified.
6.4 In the event that the Customer fails to pay, any extrajudicial collection costs will be charged.
7.1 Subject to what is stipulated in GENERAL TERMS AND CONDITIONS Article 5, LUKA FLORES will offer the accepted Orders to the courier service as quickly as possible, but no later than within three days after receipt of the payment, unless a different delivery term has been agreed upon. In the event that the delivery suffers delays, or an Order cannot be fulfilled or can only be partially fulfilled, the Customer will be notified of this no later than three days after he or she placed the Order. In that case, the Customer is entitled to dissolve the Agreement at no cost.
7.2 If the customer provides inaccurate information or incorrect shipping address, the latter undertakes an obligation to reimburse us for all related expenses incurred from delivery, etc.
7.3 Following dissolution in accordance with the previous paragraph, LUKA FLORES will immediately repay the amount that the Customer paid.
7.4 The following delivery fees are applied:
i) Lithuania: delivery within the territory of Lithuania is free;
ii) Baltics: delivery within the territory of Latvia, and Estonia is 3 EUR;
iii) European Union countries: delivery fee to European countries is 14 EUR;
iv) Other countries (Norway, Iceland, Switzerland, Canada, USA and Russia): delivery fee to other countries is 18 EUR*. (* When shipping more than one item, additional costs may apply. For exact delivery costs, please follow the information at the checkout or contact us at email@example.com)
Regarding charges of delivery to countries, other than listed above, please send an inquiry by email: firstname.lastname@example.org.
7.5 For Orders with a value of more than EUR 200.00, LUKA FLORES will not charge any shipping costs if the order is to be sent to an address within European Union. If the Order is to be sent to an address outside Europe, LUKA FLORES will not charge any shipping costs if the value of the Order exceeds EUR 400.00.
7.6 In the event that the Customer has chosen a more expensive delivery method than the cheapest standard delivery, LUKA FLORES will not repay the additional costs of the more expensive method. The Customer must send a request for such opportunity by e-mail: email@example.com
7.7 We deliver within the territory of Lithuania, all European Union countries also to Norway, Iceland, Switzerland, Canada, United States of America and Russia. Under a separate agreement, we can deliver to any other country in the world. To order this service, please send us an email to the address: firstname.lastname@example.org.
7.8 If the customer requires the item to be delivered to a country outside the European Union, the latter undertakes an obligation to pay all import taxes, customs and/or intermediation charges, if applicable, for the transportation or distribution of the items listed in the order. The customer is held responsible for the provision of all the information and documents required by the customs or other authorities of the customer’s country for proper and effective delivery of the ordered item to the customer. We recommend prior to completing the purchase authorization to consult the local customs authorities regarding the final price of the item delivered to the country in question.
7.9 The title to Products only passes to the Customer after the purchase amount has been paid in full.
7.10 LUKA FLORES dispatches the order within 3 working days from the day of customer’s payment for the item.
7.11 Within the territory of Lithuania, Latvia, Estonia items are delivered within 1–2 working days from the day of dispatch, except for Neringa (Lithuania). No dispatch confirmation is sent to the Customer.
7.12 To foreign countries and Neringa (Lithuania): items sent abroad and to Neringa (Lithuania) are delivered within 2–18 working days from the day of dispatch. To foreign countries, we will send a dispatch confirmation to the Customer by email containing also shipment number for tracking the item. Please note that not all countries provide with the postal services of item tracking.
8. USER FEEDBACK, AND OTHER SUBMISSIONS
If, at LUKA FLORES request, the Customer sends certain specific submissions (for example contest entries) or without a request from us the Customer sends creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that LUKA FLORES may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
9. RETURN & EXCHANGE
9.1. During a reflection period of fourteen days (hereinafter: the “Reflection Period”), the Customer can dissolve the Agreement without giving any reasons (hereinafter: the “Right of Withdrawal”).
9.2. The Reflection Period commences on the day on which the Customer or a third party designated by the Customer received the Product. In the event that the Customer ordered several Products in the same Order, the Reflection Period commences on the day on which the Customer or the third party designated by the Customer received the last Product.
9.3. During the Reflection Period, the Customer will handle the Products, the packaging and the labels with care. The Customer will only unpack or use the Product to the extent required to determine the nature and characteristics of the Product. The starting point in this is that the Customer may only use and inspect the Product as it is customary in a physical shop.
9.4. The Customer is liable for any decrease in value of the Product that results from any handling by the Customer in breach of the previous paragraph.
9.5. In the event that the Customer wishes to exercise his or her Right of Withdrawal, he or she informs LUKA FLORES of this within the Reflection Period by means of the Product(s) Return Form (click here for the Return form).
9.6. The Customer returns the Product (including the labels) as quickly as possible, but in any event within the Reflection Period.
9.7. The Customer returns the Product together with all accessories delivered, in the original condition and packaging.
ii) the Product has to be packed and sent back to our address: JSC „LUKA EMA“, Subačiaus str. 19-14, Vilnius, Lithuania, LT- 01300;
iii) upon receipt of the faulty Product returned, we will inspect it and if the returned Product is confirmed as being faulty, a new Product will be sent by us to the Customer within the period of three working days;
iv) if we do not have the returned Product in its original colour or size in stock, we will refund the full price paid for the Product within five calendar days;
v) if a faulty item is returned or exchanged, we will cover its return and exchange expenses.
9.11 LUKA FLORES assumes no responsibility for any damage, destruction or loss of the Product during its delivery back to us and we will not cover any losses. LUKA FLORES recommends choosing the most reliable mode of shipment and to ensure the item that is sent back to us.
9.12 LUKA FLORES will not accept return shipments if the Customer fails to satisfy the conditions stipulated in this article.
9.13 The risk and the burden of proof for the correct and timely exercise of the Right of Withdrawal fall on the Customer.
9.14 LUKA FLORES will process return shipments within 14 days after receipt and will send the Customer a confirmation e-mail regarding this. If the Customer failed to provide all the information required based on this article, the processing by LUKA FLORES may take longer.
9.15 For the repayment, LUKA FLORES uses the account number that the Customer specifies in the Product(s) Return Form. The repayment does not result in any costs for the Customer.
9.16 Products that the Customer purchased in the Web Shop can only be returned in the manner stipulated in these terms and conditions.

The Customer can submit complaints by e-mail to email@example.com. LUKA FLORES will handle complaints within five working days.
13. OTHER PROVISIONS
13.1. In the event that one of these terms and conditions is null or voidable, this will not influence the other terms and conditions.
13.2. LUKA FLORES is entitled to review and amend these general terms and conditions at any time. It is the Customer‘s responsibility to check this page periodically for changes. The general terms and conditions are published here.
14. APPLICABLE LAW
All Agreements and these terms and conditions are governed exclusively by the law of The Republic of Lithuania.
